Rape accused acquitted

JAMMU, June 1: Principal Sessions Judge Kathua, M K Hanjura today acquitted one Mohd Amin, son of Bashira of Chaki Sajan, Kathua, who was facing trial in rape and kidnapping case for the last seven years.
According to the police case, on September 12, 2006 the prosecutrix was abducted by the accused when she was on her way to home after purchasing medicine from the market. The accused took her to Delhi where he raped her a number of times till she was recovered by the police on September 18, 2006.
On the completion of the investigation of the case, a charge sheet for the commission of offences under Sections 376/366 RPC was presented in the court of law.
After hearing both the sides, Principal Sessions Judge observed, “there is considerable weight and force in the argument that the prosecutrix was a consenting party. It is supported by the evidence on record. The prosecution version has not been supported by any evidence. The prosecutrix has herself destroyed the prosecution edifice”.
“A judicial process cannot be issued in the instant case where there is no satisfactory evidence to connect the accused with the commission of the crime. The case straightaway merits the acquittal of the accused”, the court said. Accordingly, the accused was acquitted of the charges levelled against him.
