JAMMU, Feb 15: Under the guidance and patronage of chief patron of State Judicial Academy, Justice N. Paul Vasanthakumar, Chief Justice, High Court of Jammu and Kashmir and Committee of Judges, State Judicial Academy (Justice Muzaffar Hussain Attar, Chairman and Justice Hasnain Masoodi, Member), One day refresher course for Sub-Judges and Munsiffs of Districts of Jammu, Samba, Kathua, Udhampur and Reasi on “Sections 9, 10 and 11 of Code of Civil Procedure” and “Sections 100, 488, 514 of Code of Criminal Procedure” was organized today by the Jammu and Kashmir State Judicial Academy here.
Justice (Retd) O.P. Sharma was the resource person. The programme was conducted by Pawan Dev Kotwal, Director, State Judicial Academy. In his introductory remarks, Director, State Judicial Academy deliberated on the need for such refresher programmes for the Judicial Officers.
Justice Sharma in his address exhaustively explained the provisions of Sections 9, 10 and 11 of the Code of Civil Procedure in the first sessions of the Refresher Course and while dealing with the topic made a mention of the growing arrears in subordinate courts and observed that if there would have been strict adherence to the provisions of the procedural law while dealing with civil cases, the arrears would have been much less and courts could decide the cases in minimum possible time.
He enlightened the participants about the trial of civil suit and in particular told the participants as to how the trials of civil cases is to be managed and what can be done for ultimate expeditious disposal of cases.
Justice Sharma by his long and varied experience enlightened the participants regarding ways and means which they can adopt while dealing with criminal cases and reminded the Magistrates about their powers, duties and responsibilities in the second session of the Refresher course on the topic “Section 100, 488, 514 and 540 of the Code of Criminal Procedure” and referred some authoritative pronouncements of the Apex Court, which they have to keep in mind while dealing with the cases. He exhorted the Judicial Officers to follow the procedural law in letter and spirit.
All the participants took active part in the deliberations and raised some pertinent questions during interaction to the resource person who cleared the doubts lurking in their minds about various provisions of substantive and procedural law.
