Release unpaid salary of JKI employees: HC

Srinagar, Nov 16 : High Court while fixing responsibility on Principal Secretary Finance and Commissioner Secretary Industries and Commerce Department has directed them to ensure unpaid salary of dozens of the employees working in the J&K Industries (JKI) is released within one month in their favour.
Fifty-seven employees have approached the court claiming to be in a long- standing service of JKI at the lower rung of the service cadre seeking release of their last four months unpaid monthly salary from the end of JKI and also recurring payment of salary in the future.
Senior Counsel S A Makroo on behalf of these employees submitted before the court that the petitioners have been continuously representing the authorities concerned for disbursement of the salary as they (authorities) are duty bound in terms of law to release the salary on the first day of every month.
He added that the concerned authorities, however, are delaying the payment of the salary as a result of this fact the petitioners are suffering and are not in a position even to deposit the monthly fee of their school going children.
The Court has directed these authorities including Managing Director JKI to redress the grievance of these aggrieved employees with regard to their unpaid salary within a period of one month.
Justice Rahul Bharti after hearing the Senior counsel Makroo on behalf of these aggrieved employees directed the Principal Secretary Finance Department, Commissioner Secretary Industries & Commerce and Managing Director of JKI to attend their respective end and from their respective scope of office to the purported grievance of the petitioner-employees with respect to their unpaid salary and also regular payment of salary in future.
Court directed all these officials to pass requisite directions to said effect to ensure that these employees are able to have their claimed unpaid salaries in their hands. “…they are not bothered with loss of salary for the service in future in case petitioners are reckoned to be in actual service in JKI”, Justice Bharti said.
The court directed the compliance of direction be carried out at the end of all these three officials within a period of one month and any adverse outcome of the consideration at the end of these authorities shall enable the aggrieved employees to come up with a fresh plea before the court.
The court directed the Registrar Judicial of the court to send the instant order to all the three officials for notice and compliance.
