JAMMU, Nov 30: Principal Sessions Judge Bhaderwah M K Sharma today awarded rigorous life-imprisonment to Mohammad Iqbal, son of Imam Din Jaral of Mangota tehsil Doda, who was facing trial in murder case for the last 9 years.
According to the police case, the deceased Said-Ullah, son of Shamas Din of Mangota, Marmat Tehsil Doda was Naib Sarpanch of his Panchayat. During militancy, the security forces used to have liaison with the deceased. The accused had an impression that it was on the basis of information provided by the deceased that the security forces launched search operations in their village and had developed enmity with the deceased.
On June 29, 2002, the accused attacked the deceased and caused severe head injuries, which proved fatal resulting in death of deceased.
After hearing both the sides, Principal Sessions Judge observed, “the prosecution has proved the commission of offence under Section 302 RPC & 4/25 Arms Act against the accused, who is accordingly convicted for the commission of offences under Sections 302 RPC and 4/25 Arms Act”.
“The attending circumstances of the case does not warrant extreme penalty of death sentence. Though a young person of 35 years has lost life in the instant case by the act of the accused but it does not fall in the category of rarest of rare cases where the death sentence is warranted”, the court said while awarding rigorous life imprisonment to the convict.
