Rigorous life-imprisonment to father, 4 sons in murder case

JAMMU, Feb 19: Principal Sessions Judge Samba, Kartar Singh today awarded rigorous life-imprisonment to Thoru Ram, son of Ram Dayal of village Dera Khidian, Samba and his four sons namely Vikas Thappa, Parveen Thappa, Anil Kumar Thappa and Ajay Kumar Thappa in a murder case.
According to the police case, on August 8, 2008 two brothers namely Sikander Singh and Jagdish Singh were attacked by the accused persons with sharp edged weapons over a trifle issued. After causing grievous injuries to both Sikander and Jagdish all the accused fled from the spot. Later, both the critically injured persons were rushed to hospital by some villages and later Jagdish succumbed to injuries.
After hearing both the sides, Principal Sessions Judge observed, “it is true that Section 302 RPC mandates that whoever commits murder shall be punished with death or imprisonment for life and shall also be liable to fine. The settled law of land is that life imprisonment is a rule and death penalty is an exception and should be awarded in the rarest of rare cases”.
“Taking into consideration the circumstances under which the crime has been committed, it is found that it is not a rarest of rare case and it is a fit case where the accused deserves only life imprisonment”, the Court observed and awarded rigorous life imprisonment to all the five accused persons. The Court, however, clarified that all the sentences will run concurrently.
