The High Court had upheld the judgment of the CAT Srinagar and directed reinstatement of one Fayaz Ahmed Lone, Store Keeper, Kulangam Grainery Kupwara.
Fayaz Ahmed Lone had been terminated on the ground that he had been charge-sheeted by the Anti Corruption Branch of the CBI in an FIR for misappropriation of Government ration.
The bench of Justice Dipankar Datta and Justice N Kotiswar Singh heard arguments from Rushab Aggarwal, Standing Counsel on behalf of the Union Territory of Jammu & Kashmir, who stated that the High Court had failed to give any finding on errors of fact made by the CAT in its order.
Admitting the SLP, the Supreme Court bench issued notice on the petition.
