JAMMU, May 13: Supreme Court has dismissed the Special Leave Petitions (SLPs) filed by Government of Union Territory of Jammu and Kashmir challenging quashment of Anti-Corruption Bureau FIR against Jasvinder Singh Dua, former Managing Director of SICOP by High Court of J&K.
After hearing counsel for the petitioner-J&K Government, a Bench of the Supreme Court comprising Justice A S Bopanna and Justice Sanjay Karol observed, “in the facts and circumstances of the instant case, we see no reason to interfere with the judgment impugned. The Special Leave Petitions are, accordingly, dismissed. However, the question of law, if any, arises, it is left open”.
High Court had quashed the FIR registered against Jasvinder Singh Dua with the observation that promotions earned by Jasvinder Singh admittedly have been made upon the recommendations of Departmental Promotion Committee and not individually by the Managing Director in league with Bopinder Singh Dua as was alleged.
“No material or evidence worth the name seemingly is available on the record in the CD file prima facie disclosing the commission of the offences alleged against the petitioner under Section 5(1) (d) read with Section 5(2) of the J&K Prevention of Corruption Act”, High Court had further observed.
