Srinagar, June 26: The Supreme Court today issued notice to Government of J&K and sought reply to the plea filed by J&K High Court Bar Association President Mian Abdul Qayoom challenging the judgment of High Court whereby his detention was upheld.
Justice Sanjay Kishan Kaul and Justice B R Gavai after hearing the senior Counsel Dushyant Dave with advocate Vrinda Grover on behalf of Qayoom issued notice to J&K Administration for filing of reply to the plea by next date.
Qayoom has approached the Supreme Court by way of Special Leave Petition (SLP) challenging the judgment of Division Bench of High Court whereby his detention was upheld. The High Court had left it open for the Government to consider his release if any application is made for releasing him of parole in view of his health conditions.
The appeal before High Court was preferred by Qayoom against the judgment of writ court in which his petition for seeking quashing his detention was turned down on 7.2.2020 and upholding his detention.
Qayoom was detained on August 7 last year under detention order dated DMS/PSA/105/2019 passed by District Magistrate Srinagar with a view to prevent him from acting in any manner prejudicial to the maintenance of public order.
Meantime as interim measure, the Apex Court ordered for providing of summer clothing and other essentials to Qayoom in jail.
