SC orders CBI enquiry into Rajneesh Sharma death case

JAMMU, Sept 19: Supreme Court of India has issued directions for Central Bureau of Investigation (CBI) enquiry into the much-publicized alleged death of Rajneesh Sharma, a resident of New Plots in the custody of Srinagar Police.
After hearing Pinky Anand, Senior Counsel for the petitioners (Anchal Sharma alias Amina Yusuf and others) and Senior Advocate Gaurav Pachnanda and Advocate Sunil Fernandes for Jammu and Kashmir, a bench of the Supreme Court comprising Justice Chandramauli Prasad and Justice Jagdish Singh Khekar observed, “it is a case of custodial death. We are not expressing any opinion in regard to the merit of the allegations as that will prejudice either party”.
“However, we find that the allegations made prima facie disclose commission of a cognizable offence. Hence, we are of the opinion that same deserve to be investigated by the Central Bureau of Investigation”, the SC bench observed.
Accordingly, the SC directed State to register a First Information Report and investigate as to whether Rajneesh Sharma was murdered and if so, the persons responsible for that. In case, it is found that Rajneesh Sharma was done to death by the police or with their connivance, the petitioners shall be at liberty to file appropriate application for grant of compensation and such other reliefs as they may be entitled in law before appropriate court.
