SC stays order directing schools to refund fee

JAMMU, July 26: Supreme Court has stayed the impugned judgment and order passed by the J&K High Court whereby KC Gurukul and other schools were directed to refund the entire fee beyond the fixed scale along with the interest at the rate of 9% per annum.
The Division Bench of State High Court vide judgment dated March 18, 2019, while dismissing the petitions filed by KC Gurukul and other schools, had directed them to refund the entire fee beyond the scale, which was chargeable by them uptill August 2014 in terms of the judgment and order dated September 29, 2016 passed by the Division Bench in OWP No.910/2016.
“The fee so refunded shall be paid along with interest at the rate of 9% per annum on the said sum”, the DB had further directed.
The judgment and order of the Division Bench was challenged before the Supreme Court and in the SLP filed by KC Gurukul Public School and Others, the Apex Court bench comprising Justice S A Bobde and Justice B R Gavai directed that there shall be stay of operation of impugned judgment and order passed by the High Court.
