Shoddy investigation leads to acquittal of husband, in-laws

JAMMU, Nov 13: Principal Sessions Judge Udhampur, R S Jain has acquitted husband and in-laws of a woman, who were facing trial in her abetment to suicide case, as prosecution failed to prove the case.
The accused namely Mohd Razak (husband), Saleema (mother-in-law), Mohd Salim (father-in-law) and Musleen (sister-in-law) were facing trial in abetment to suicide of Ishrat Akhtar. The accused persons were harassing Ishrat Akhtar for want of more dowry.
After hearing Advocate Pawan Jandial appearing for the accused persons, Principal Sessions Judge observed, “it is a settled principle of law that prosecution is under an obligation of proving the guilt of accused beyond reasonable doubt by cogent and clear evidence”.
“In the present case, prosecution has been unable to prove the guilt of accused beyond reasonable doubts by cogent and clear evidence. Applying these principles, this court is of the opinion that the evidence falls short of the required standard of proof”, Principal Sessions Judge said.
Accordingly, the court acquitted the accused Mohd Razak, Saleema Begum, Muslim Akhtar and Mohd Saleem.
