SIC imposes Rs 25,000 penalty on Tehsildar Bahu

JAMMU, Sept 21: State Information Commission (SIC) has imposed a penalty of Rs 25,000 on M I Naik, tehsildar, Bahu for his failure to comply with the orders and directives issued by the Commission in the second appeal as well as the complaint for non compliance regarding an information sought by one Karan Singh about the construction of road passing through Khasra No 831.
The Tehsildar has also failed to respond to the show cause notice issued by the Commission as to why penalties will not be imposed upon him under Section 17 of the J&K RTI Act, 2009.
The Commission, while passing strictures against the Tehsildar in a recent decision for denial of information to the complainant Karan Singh regarding road passing through Khasra No 831 and the details about the acquisition of land passing through Khasra No 831 and details about acquisition of land falling in Khasra No 831 for construction of the said road issued orders for imposing penalty against him. Though Tehsildar was directed to provide the information within 10 days and file compliance report before the Commission he failed to do so. He also did not appear before the Commission during the hearings held on 24-09-2018 and 15.10.2018.
The Commission in its order said the tehsildar did not appear in the hearings even once in spite of notices and explanations issued by the Commission for his non compliance of directions of Commission.
The Commission has issued directives to Drawing/Disbursing Officer of the Tehsildar, Bahu to deduct the amount of Rs 25,000 from his salary in three monthly installments. The Treasury Officer , District Jammu has also been directed no to entertain any salary bill from the concerned DDO unless the amount of penalty is deducted in three installments form the salary of M I Naik, tehsildar Bahu and remitted in the State treasury.
SDM Jammu, South is also directed to ensure that the amount of the penalty imposed on M I Naik is deducted form his monthly salary by the concerned DDO. He is also directed to collect the information from Tehsildar , Bahu with respect to RTI application dated January 1, 2018 of the complainant and provide the same to him in terms of SIC’s Order of November 6, 2018.
