Simple imprisonment awarded to driver in accident case

JAMMU, May 20: Special Mobile Magistrate (Sub-Judge) Jammu Anoop Kumar Sharma has awarded simple imprisonment to Puran Chand Sharma, son of Munshi Ram Sharma of Kathar Manwal whose rash and negligent driving had led to accident of a mini-bus and injuries to several members of a marriage party on March 25, 2010.
After hearing Prosecuting Officer Shalini Gupta for the State and Advocate Hakumat Singh for Puran Chand Sharma, the Special Railway Magistrate observed, “the prosecution has succeeded in proving its case beyond a reasonable shadow of doubt and its stands proved that accused was driving the vehicle negligently which led to the accident”.
“The accused is convicted of negligent driving which is punishable under Section 279 RPC. He is also convicted of endangering human life punishable under Section 337 RPC”, the court said, adding “in view of the fact of long drawn trial and accused being first offender lenient view is taken in awarding punishment”.
Accordingly, he was awarded one month simple imprisonment and a fine of Rs 1000 under Section 279 RPC, one month simple imprisonment and fine of Rs 500 under Section 337 RPC and one month simple imprisonment and fine of Rs 500 under Section 338 RPC. “All the sentences shall run concurrently”, the court said, adding “in default of payment of fine the accused will undergo a further one month simple imprisonment”.
