We have J&K Compassionate Appointment Rules 1994 notified under SRO-43. Appointment on compassionate grounds for non-gazetted service of Class IV post is made under this provision against available vacancy provided the applicant is eligible for the post. Taking a humanistic view of appointments in this category, the Government has made amendment in the rule. Now the time allowed for eligibility will be five years instead of one year from the date of death of the deceased person. In other words if the ward of a deceased person is a minor and needs five years age-wise to become eligible for employment, the facility is made available to him. It is a pure humanitarian act.
This rule is applicable to any civilian who is killed owing to militancy related action. We know that there is usually unprovoked and sudden firing across the LoC or the IB from other side which Indian security forces have to respond. In such eventualities, sometimes civilians not at all involved in militancy, are caught in the cross fire and get killed. The amended rule is also applicable in such cases. Of course, there is the condition that the income of the deceased person’s family from all sources does not exceed five thousand rupees per month. Even this slab has been enhanced to Rs 10,000 per month thereby enabling more families to get benefit of compassionate appointment.
The amendment to the SRO in question was necessitated by the humanistic approach to such incidents.
