Srinagar, Dec 10: Srinagar Police have denied having seized 2-wheelers last month in the district and said that the allegations levelled against it in an application filed in a court are “baseless” and “far from the reality.”
In a response that was filed by the Senior Superintendent of Police (SSP) Srinagar to the court, the police have said that the allegations levelled against District Police Srinagar are vehemently denied, “being baseless, far from facts and reality and nothing more than a mere figment of imagination on part of the applicant herein,” the SSP said.
The SSP said that his office received a copy of the order in which it was directed to call report from all Police Stations with regard to allegations that District Police Srinagar has been allegedly detaining vehicles illegally and allegedly exercising powers of a Traffic Magistrate by releasing them of their own.
Earlier, it is to be noted, Additional Special Mobile Magistrate (Traffic) had sought a report from the Senior Superintendent of Police (SSP), Srinagar in the matter of “illegally detaining” the 2-wheelers across district Srinagar, after an application was filed seeking its indulgence.
The SSP has said that a report was sought from SDPO Shaheed Gunj and SHO P/S Batamaloo- Non-applicant-to arrive at the facts as the applicant has made specific allegations in his application.
The response stated that the non-applicants have stated that the vehicle of the applicant was neither detained nor seized. “Thus, the allegation of releasing the same by allegedly exercising powers of a Traffic Magistrate are vehemently denied being not correct, baseless, far from facts and reality,” police said.
The response filed by the SSP further stated that the applicant has no locus to file the instant application before the Court “and same being devoid of any merit deserves rejection with costs.”
“Compounding of Challans fall within the exclusive purport and domain of Traffic Police and District Police Srinagar/non-applicants has nothing to do with it; District Police Srinagar/Non-applicants have the highest respect of rule of law and are an accountable/ responsible Govt functionary having complete adherence and utmost regard to authority and powers,” the SSP stated.
The Srinagar police chief said that having acquaintance of the accountability and responsibility, the District Police Srinagar “never ever supersedes” the authority/ power of a Magistrate/Judge.
“It is submitted before this Court that from the submissions it is explicitly clear that allegations levelled against Police non-applicants are baseless, contrary to facts and reality and are not correct. Thus, instant application deserves to be dismissed,” the SSP said.
