BIJBEHARA, Aug 24: JMIC (Sub-Judge) Bijbehara has convicted Rafeeq Ahmad Guroo for his rash and negligent act of driving not only endangering public life on road but causing loss of a precious life.
The convict was booked under Sections 279, 304-A RPC in case FIR No. 25/2012 registered at Police Station Srigufwara.
After hearing Assistant Public Prosecutor Jaweed Ahmad Sheikh and the defense counsel, the court observed, “the prosecution case has ring of truth in it and is proven by cogent and credible evidence. All the requirements of law stands proved beyond reasonable doubt”.
“The accused by his rash and negligent act of driving not only endangered public life on road but caused loss of a precious life directly by his act. Accordingly the accused is held guilty of the charge of offences under Sections 279, 304-A RPC and is accordingly convicted”, the court said.
However owing to the advanced age of the convict and because of his extreme domestic liabilities, the convict was given the benefit in terms of Section 4 of J&K Probation of Offenders Act, 1966 and was directed to furnish a bond of good for a period of next one year.
