JAMMU, Apr 29: State Vigilance Organisation today filed a challan in the court of Additional District and Sessions Judge Anti-Corruption, Doda against the then Storekeeper of CAPD Department.
The accused CAPD officials, Tariq Hussain Ganai, son of Mohd Ramzan Ganai, resident of Bhaderwah, was booked by the SVO in case FIR No.18/2007 u/s 5 (1) (e) r/w Section 5(2) of J&K PC Act. He was then posted as storekeeper and given premature retirement.
Giving brief facts, an SVO officer said that the instant case was registered in Police Station Vigilance Organization, Jammu on the outcome of secret verification into the allegations that the accused has raised a number of immovable assets including additional two-storeys over his ancestral house at Mohalla Haveli at Bhaderwah. A triple storey residential house with two shops adjacent to the above residential house at Mohalla Haveli Nagar, Bhaderwah.
It was discovered that Ganai also has a residential house No 4/20 at Hyderpura, Janipur Jammu. The Janipur house was purchased by the accused for a consideration of over Rs 40 lakhs including cost of the plot. The accused has purchased in his own name and in the name of his father a number of vehicles which include a truck, mini bus and a car. The accused has remained posted as Storekeeper at various stores of CA&PD Department. The value of movable/immovable assets raised by him during his service career has been found disproportionate to his known source of income.
A prima facie case for commission of offence punishable u/s 5(1)(e) r/w 5(2) J&K PC Act Samvat 2006 has been established against accused official. During the course of investigation, search warrants were obtained from the Special Judge(Anti-corruption) Jammu and searches of residential premises of the accused person at two additional storeys over the ancestral house of accused at Mohalla Haveli Nagar, Bhaderwah; a triple storey residential house with two shops adjacent to above residential house at Mohalla Haveli Tehsil Bhaderwah; a residential house No 4/20 Hyderpura, Janipur Jammu were conducted on 30.06.2007 by the different vigilance teams after observing legal formalities in presence of independent witnesses.
During the course of investigation, statements of witnesses were recorded u/s 161 CrPC r/w 162 CrPC (as amended) and record pertaining to immovable and movable assets of the accused and his family members was collected from the concerned quarters. On the strength of evidence, oral and documentary, collected during the course of investigation, it has been established that the accused has raised assets disproportionate to his known sources of income by Rs 36,60,572. Thus, going by the facts and figures collected during investigation, it has been established that the accused official has accumulated huge disproportionate assets. As such a case has been established against the accused Tariq Hussain Ganai (now prematurely retired).
