Srinagar, Nov 29: The Member Legislative Assembly (MLA) Kulgam and Communist Party of India (Marxist) leader M.Y. Tarigami today condemned a recent civil court decision ordering a survey of the Ajmer Sharif Dargah to investigate claims of a temple beneath it.
“At the first place, entertaining such a petition is unacceptable to us. This move is unwarranted and lacks legal merit, contravening the Places of Worship (Special Provisions) Act, 1991,” he said.

Tarigami accused the Government of encouraging such issues to promote division and polarization, which, he said, “is not good for the country and goes against communal harmony.”
The CPI(M) leader emphasized that the Act explicitly prohibits raising disputes over religious sites established before August 15, 1947.
He also pointed out that the Ayodhya verdict “did not do justice in the real sense,” adding that the Supreme Court itself has stated the Act should not be violated under any circumstances.
The party highlighted that such decisions have already led to violence and unrest, citing the Sambhal Masjid survey, which resulted in the loss of five lives.
The CPI(M) urged the Supreme Court to intervene immediately, referring to its own 2019 Ayodhya judgment, which upheld the Places of Worship Act.
He warned that allowing such disputes to proceed would undermine the country’s secular fabric and perpetuate communal tensions.
