SRINAGAR, Aug 12: The Vigilance Organization Kashmir has booked then Tehsildar Uri, Shafat Noor, then Girdwar Uri Habibullah Mir and then Patwari, village Jabla Uri, Mohammad Bashir for forging mutation of State land in the name of accused beneficiary entitling latter for compensation from NHPC.
The verification conducted by VOK revealed that these three Revenue officials and beneficiary Bashir Ahmad Mir of Sultandaki Uri, hatched a criminal conspiracy with each other and dishonestly transferred / mutated State land measuring eight kanals and nine marlas under Khasra No. 20 at village Jabla Uri in the name of above mentioned beneficiary under the garb of Government orders LB-6 and S- 432. The land has been shown in the name of Bashir Ahmad Mir prior to 1969 but as per record of rights from the year 1959-60, the said land was found recorded as Gairmumkin Nallah. Besides, under Jamabandi 1965 the land has also been found recorded as Gairmumkin Nallah and same has not been found in occupation/possession of any person.
By this forged transfer/ mutation of the State land, an amount of Rs 9,71,750/ was assessed as compensation on account of land acquisition by NHPC, out of which Rs 7,77,400/- (80 percent) has been paid to the beneficiary.
In this way, the accused public servants rendered pecuniary benefit of Rs 9, 71,750/- to Bashir Ahmad Mir and subsequent loss to the State exchequer.
The omission /commissions on the part of these public servants attracts provisions of offence under Section 5(1) ( d) read with 5(2) Prevention of Corruption Act Svt 2006 , Section 120-B, RPC and accordingly a case FIR No.35/2015 P/S VOK was registered and the further investigation has been taken up.
Meanwhile, a Senior Assistant in the office of Commissioner Commercial Taxes, Kashmir, was caught red handed by the Vigilance sleuths while demanding and accepting bribe for issuance of passenger tax books.
The accused, identified as Gulshan Ahmad Itoo of Nagam Chadoora, was caught red handed by a trap team headed by DySP Muneer Ahmad in the presence of independent witnesses.
The accused was demanding and accepting a bribe of Rs 12000 from the complainant Aijaz Ahmad Sheikh for issuance of passenger tax books of his three vehicles. A case FIR number 36/2015 under Section 5(1) (d) 5(2) P.C Act 2006 read with 161 RPC has been registered at Police Station VOK.
