Tough posture on Jammu and Kashmir issue

Prof. Virender Gupta
The leaders of National Conference and that of People Democratic Party have been confusing the people of Jammu and Kashmir, particularly those of Valley about their stand with regard to the accession of Jammu and Kashmir with India. Because of their varied statements and the stands they took from time to time, they have been instrumental in creating separatist tendencies in the Valley and in alienating the people of Valley from the national mainstream. Intentionally or unintentionally they have been raising questions about the settled issue of Jammu and Kashmir i.e. it is integral part of India Union.
It may be made clear that Maharaja of Jammu and Kashmir signed the instrument of accession without any pre-condition and even the Kashmiri leadership did not lay any pre condition with regard to the accession of Jammu and Kashmir with India. It was only in the constituent assembly that Kashmiri leadership made Pt. Nehru to agree to their demand of incorporating article 370 in the Indian constitution and that too as a temporary clause. There was no dispute about the accession and about the territory of J&K state that came under the territorial jurisdiction of Union of India. As per the Jammu and Kashmir Constitution and as per the Indian Constitution the whole of the territory of Jammu and Kashmir state that existed in 1947 before the aggression of Pakistan became the part of Indian Union. It may be emphasized that Kashmiri leadership endorsed the accession of Jammu and Kashmir State with India that too without taking the people of Jammu region and Ladakh region into confidence. It should be the concern and duty of the Government of India to get back the part of Jammu and Kashmir State illegally annexed by Pakistan in 1947. The matter comes under the jurisdiction of the Union Government, the Government of Jammu and Kashmir State and for that matter the Kashmiri leadership has no role to play except to impress upon the Government of India to get vacated the same from Pakistan. The   Government of India as well as Indian masses are duty bound to get vacated part of J&K that is in possession of Pakistan as per the unanimous resolution passed by the Indian Parliament in 1994.
The statements made by the Kashmiri leadership from time to time that “Accession of Jammu and Kashmir is not final; there is no final settlement of Jammu and Kashmir; Jammu and Kashmir is a disputed issue; Jammu and Kashmir Issue is still to be resolved; there should be a tri-parties talk between India, Pakistan and Kashmiri leaders to settle the issue; etc.” create confusion and damage the Indian cause. By doing so they are working against the national interests and serving the Pakistan cause. The Kashmiri leaders have no locus standi in any talk between India and Pakistan about the Jammu and Kashmir issue Their repeatedly assertion to take part in the talks between India and Pakistan is obnoxious. Further, the Kashmiri leaders and the separatists do not represent the voice of the people of Jammu and Kashmir and in particular those residing in Jammu and Ladakh regions and those pertaining to Gujjar/Bakarwals and Shia Communities, in this matter.
No doubt the issue of Pakistan aggression in 1947 was taken to the United Nations by the Government of India and the UNO resolution on the matter could not be implemented as the Pakistan did not vacate the areas of erstwhile J&K occupied by it. After 67 years the resolution of UNO has become irrelevant as  Pakistan at no stage shall going to vacate the part of Jammu and Kashmir State that is under its illegal occupation and as such the exercise to hold Plebiscite to ascertain the opinion of the people with regard to the accession of J&K State with India or Pakistan becomes unwarranted. Further, during this period the demography of the various parts of Jammu and Kashmir State, particularly those under the occupation of Pakistan have undergone a sea change. Even the former General Secretary of United Nations has spoken the irrelevance of the UNO resolution of 1948 at this stage.
The Hurriyat leaders who consider themselves as thakedar (custodian) of Kashmiri people are basically Pakistani touts, who serve the interests of their masters in Pakistan. Unfortunately the Kashmiri leadership and Congress Party had been adopting soft policy towards the anti India acts of Hurriyat leaders and towards the secessionist elements and terrorists due to Vote Bank politics. This has resulted into the present challenging situation in the Valley and in J&K as a whole. It is need of the hour to take offensive action against the terrorism and  Government of India should put the Hurriyat leaders behind the bars and should prosecute them for their heinous crimes and secessionist acts. Their claim for being the party in any of the dialogue between India and Pakistan on Jammu and Kashmir issue should be completely rejected and no opportunity, like meeting the Pakistan envoy in India or any other dignitary of Pakistan visiting India, should be allowed to them. The need of the hour is that India should look towards Pakistan as dangerous neighbour and adopt tough policy towards it.
