JAMMU, Aug 6: Principal Sessions Judge Poonch, Kishore Kumar has acquitted two woman namely Sagira, wife of Wazir Mohd and Parvez Akhter, wife of Munir Hussain, both the residents of Dingla, Poonch, who were facing trial in abetment to suicide case of one Shafayat, as prosecution failed to prove the guilt of accused by cogent and clear evidence.
According to the police case, on June 15, 2005 Sarpanch Halqa Dingla, Mohd Din informed Poonch Police telephonically that one Shafayat, wife of Khadam Hussain of Dingla has died after consuming poisonous substance. On this report, proceedings under Section 174 of CrPC commenced. During the proceedings, it was found that Shafayat was being harassed by her neighbourers and relatives namely Sagira Bi, Pervaiz Akther and Ikhlaq Ahmed on the pretext that she was having illegal relations with one Mohd Ayoub, son of Wazir Mohd of Dingla.
On June 15, 2005, Shafayat committed suicide after finding it difficult to tolerate allegations. On this, an offence under Section 306/34 RPC was registered against the accused persons.
After hearing Public Prosecutor Nazir Hussain Choudhary whereas Advocate Anuj Kapoor for the accused persons, Principal Sessions Judge Poonch observed, “the evidence direct as well as circumstantial adduced by the prosecution and the legal position in the present case is such that the court can conclude with unerring clarity that the prosecution has miserably failed to prove that Sagira and Parveiz Akhtar had abetted the suicide of Shafayat”.
With these observations, both the women were acquitted of the charges.
