Two yrs imprisonment to accused in assault on cop

JAMMU, Nov 19: District Judicial Mobile Magistrate (Traffic) Udhampur has awarded two years imprisonment on the accused under Section 353 RPC and 4/25 Arms Act.
According to the prosecution case, on April 3, 2006 Constable Prem Singh along with other employees of the Police Station went to Kashirah to apprehend the accused namely Raj Kumar, son of Kaka Ram in a case under Section 366 RPC.
When they reached the house of accused his father Kaka Ram attacked a cop namely Bishan Dass with a sharp edged weapon. During the scuffle, the uniform of a cop was torned and Kaka Ram was controlled with difficulty.
Accordingly, a case under Section 353 RPC and 4/25 Arms Act was registered and after completion of investigation challan was presented in the court of law against Kaka Ram, son of Chidu of Kashirah, Udhampur.
After hearing CPO Bhupinder Singh and PO Vikram Parihar, District Judicial Mobile Magistrate (Traffic), Udhampur Khem Raj Sharma observed, “the accused has assaulted a public servant by use of criminal force to deter the public servant from discharging his duty”, adding “in the circumstances a sentence of one year’s simple imprisonment is imposed on the accused under Section 353 RPC and simple imprisonment of one year under Section 4/25 Arms Act along with fine of Rs 500”.
“In default of payment of fine, the accused will further undergo simple imprisonment for one month. The imprisonments will, however, run concurrently”, the Court said.
