Two yrs imprisonment to driver for killing pedestrian

JAMMU, Aug 14: Judicial Magistrate Ist Class (Sub-Judge) Uri, Rajesh Kumar Abrol has awarded two years simple imprisonment to a driver, whose negligent and rash driving had snatched the life of a pedestrian.
According to the police case, one Zoona Begum, wife of Bulla Bhat was knocked to death by a Tata Sumo bearing registration number JK05A-1648, which was being driven rashly and negligently by Latief Khan, son of Sharief Khan of Dhani Saiydain from Lagama to Uri.
After hearing Prosecuting Officer for the State and Advocate Mohammad Saleem Beigh for the accused, Judicial Magistrate Ist Class (Sub-Judge) Uri, R K Abrol observed, “close analysis of the evidence recorded by the prosecution reveals that speed of the offending vehicle was 70 to 100 kilometers per house at the spot of occurrence and the vehicle was being driven in a negligent manner by the accused”.
“After hitting the pedestrian, the accused driver instead of taking any pains for carrying her to hospital for treatment turned the vehicle back and fled towards Baramulla. The attitude of accused was very unsympathetic and inhuman”, the court said, adding “the accused didn’t follow the precautions in the hilly terrain and evidently neither he slowed down the speed of the vehicle by applying brakes nor blew the horn which is mandatory under the Motor Vehicles Act”.
“By applying the principles of sifting the grain from the chaff it is established on the basis of prosecution evidence that accused was rash and negligent in driving the vehicle”, the court observed while convicting the accused.
Accordingly, the court awarded simple imprisonment of two years and fine of Rs 2000 to the accused.
