Uri court rejects bail plea of man accused of stalking

Srinagar, Jan 25: The court of Judicial Magistrate 1st class in Uri in Baramulla district has rejected a bail application of an accused involved in stalking and harassing a girl and her family.
The Judicial Magistrate Uri, Fozia Paul, denied bail to the accused Ishfaq Ahmad Pathan of Nalusah, Mohara tehsil Boniyar, for harassing, threatening, and uploading videos of a girl (name withheld) on social media.
According to an order issued by the Judicial Magistrate Uri, the statement of the victim Under Section 164 of CrPC has already been recorded.
“Perusal of the same reveals that the accused has been stalking, harassing, and threatening the victim and her family. Moreover, the victim has also claimed that the accused has been uploading videos of the victim on social media, causing a serious threat to the dignity of the victim,” the court order reads.
It stated that there is prima facie sufficient evidence on record, which leads the court to believe that the accused is involved in the commission of offenses Under Section 341, 354, 506 of IPC.
“The accused does not deserve bail at this stage, as the investigation is still in its infancy, and there is every apprehension that the accused would repeat the offense. Furthermore, the report from the FSL is awaited; therefore, it is not the proper stage to release the accused on bail,” the JM Uri said in its order.
The prosecution, while resisting bail for the accused, argued that the offense committed is heinous in nature.
“If he is released on bail, he will try to tamper with prosecution witnesses, and there is a likelihood of his absconding. The accused has committed an offense against society, and the society at large has been annoyed,” it said.
Earlier, the counsel of the accused stated that the police station in Uri, on a false, baseless, fabricated, and malicious complaint, has registered a case against the applicant without any rhyme or reason and put the applicant behind bars.
