Widow appointed on compassionate ground has right to remarry: CAT

JAMMU, June 26: A Bench of Central Administrative Tribunal (CAT) comprising M A Latif Member (J) and Parsant Kumar Member (A) has held that a widow appointed on compassionate ground has right to remarry without prejudice to the right and interests of other dependents of the deceased.
The Original Application has been filed by the applicants aggrieved by the engagement and continuation of Kounsar Maqbool as Assistant Lineman in the Department of Public Health Engineering Department (PHE) Kashmir under compassionate ground appointment scheme on the death of her husband Talib Hussain Bhat in terms of SRO 43 (J&K Compassionate Appointment) Rule, 1994.
The 1st applicant is the brother and the 2nd applicant is the mother of the deceased employee. The reliefs sought in the OA are cancellation of order of engagement of respondent in terms of which the respondent has been appointed against the post of Assistant Lineman.
After hearing both the sides, CAT observed, “a widow appointed on compassionate ground has right to remarry without prejudice to the right and interests of other dependants of the deceased”, adding “there is no merit in the OA as such the same is dismissed”.
