SRINAGAR, May 17: The High Court has directed to withhold the salary of Commissioner/Secretary and Managing Director of Tourism Department in case admitted payment to contractor is not released.
Justice Sanjeev Kumar on the request of MD Tourism who was present in the court adjourned the matter so as to enable him to take up the matter with the Administrative department in order to comply with the direction of court.
“It is made clear that in case needful is not done by next date of hearing, salary of Commissioner/Secretary and Managing director JKTDC shall not be released”, Court directed.
On previous date, court had issued bailable warrants of Rs 50000 against MD TDC for securing his presence before court. On 31st last month on the request of MD’s counsel, week’s time as final opportunity was granted for filing compliance report of court directions strictly in conformity with the court direction.
Today when the matter was called for further proceedings, MD submitted that the matter with regard to admitted pay has been taken up with the administrative department and requisite approval for release of payment is likely to be received shortly.
Advocate Arifa Jan for petitioner-contractor submitted that for not complying the court orders with regard to payment which is due to her client constrained him to file the contempt petition seeking initiation of contempt proceedings for willful defiance on part of MD.
The stand taken by counsel for MD is that for making payment, codal formalities are to be complied with and it is because of non-compliance of codal formalities that the payment could not be made.
The contractor had executed work for construction of hutments in the year 2018 in world famous tourist resort Gulmarg for which he was paid half of the amount by the Corporation and for rest of payment he was made to suffer.
